The following rules apply to all on-air, on-site, and web based contests conducted by WAMG-AM and WLLH-AM, d/b/a 890 ESPN Boston and 1400 ESPN Lowell respectively (collectively, the “Station”), unless otherwise set forth in specific contest rules for a particular contest.

1.           Eligibility and Limitations.  Participants and winner(s) must be legal Massachusetts, New Hampshire, Rhode Island, Connecticut, and Maine residents and are at least eighteen (18) years of age or older, with a valid U.S. driver’s license (or other valid proof of identity and age, e.g., non-driver’s license ID) upon entering the Promotion.  Only one (1) prize per household from any of the Company’s stations within any thirty (30) day period.  Employees of the Sponsor and their participating promotional partners and their advertising agencies, employees of other radio or television stations, and members of the immediate family of any such persons are not eligible to participate and win, including but not limited to respective parent companies, subsidiaries, affiliates, divisions, distributors, suppliers and advertising, promotional or judging agencies and immediate family members of such employees (parent, child, sibling, spouse) and persons living in the same household of such employees (whether related or not) are not eligible to win.  The term “immediate family” includes spouses, siblings, parents, children, grandparents, and grandchildren, whether as “in-laws,” or by current or past marriage(s), remarriage(s), adoption, co-habitation or other family extension, and any other persons residing at the same household whether or not related.  No groups, clubs or organizations may enter or win prizes.  All participants, as a condition of entry, agree to be bound by these rules and the decisions of Company which shall be final and binding.

2.           The prize is not transferable, redeemable for cash or exchangeable for any other prize.   If a winner is disqualified, the Company reserves the right to determine an alternate winner or not to award that winner’s prize, in its sole discretion.  No substitution of prize is offered, no transfer of prize to a third party is permitted and non-cash prizes may not be redeemed for cash value.  Company reserves the right to award a prize of greater or equal value in the event a prize becomes unavailable.

3.           NO PURCHASE NECESSARY.  PURCHASE DOES NOT INCREASE ODDS OF WINNING.  Void where prohibited or restricted by law.

4.           Prize Winners Verification/Prize Claim:  All prizes are to be picked up at Station office, WAMG-AM, 529 Main Street, Suite 200, Charlestown, MA.  Prize Winners will be required to sign and return to the Sponsor an Affidavit of Eligibility/Liability Release with (where lawful) a publicity release and present a valid U.S. driver’s license (or other valid proof of identity and age, e.g., non-driver’s license ID) at the Station’s business offices in order to claim the Prize.  If any required items/documents are not returned to Sponsor, then the Prize may be forfeited.  Any portion of a prize not accepted by winner shall be forfeited.  All travel and transportation costs, if any, associated with collecting the prize, are winner's responsibility.

Selection of Winners.  Decisions of Station management, with respect to contests, are final.  By entering the station promotion, entrants agree to abide by these contest rules.

5.           Publicity; Use of Personal Information.  By participating, where allowed by law, all participants and winner grant the Sponsor permission to use their names, photographs, voices, and likenesses in connection with the advertising and marketing of this and other promotions and waive any claims to royalty, right, or remuneration for such use.  By participating in the Promotion, where allowed by law, participants agree that the Sponsor may disclose personal information obtained from participants in the Promotion to third parties and use such information for marketing and other purposes.  Sponsor shall have the right to use winner’s name, likeness and image, for any commercial or marketing purposes without additional compensation, in perpetuity.

6.           Release of Liability.  By participating in the Promotion, each participant and winner waives any and all claims of liability against the Sponsor and their employees and agents, the Promotion’s promotional partners and their respective employees and agents, for any personal injury or loss which may occur from the conduct of, or participation in, the Promotion, or from the use of any prize.  In order to receive a prize, participants must sign an official waiver form provided by the Sponsor.  All participants, as a condition of participation, and all winners, by acceptance of a prize, agree to release Sponsor and each of their respective parent companies, subsidiaries, divisions, affiliates, suppliers, divisions, distributors and advertising, promotional or judging agencies from any and all liability, claims or actions of any kind whatsoever for injuries, damages or losses to persons and property which may be sustained in connection with the receipt, ownership or use of the prize or while preparing for, participating in, and/or traveling to and from any prize-related activity or any typographical or other error in the printing of these Official Rules or the offering or announcement of any prize.  Sponsor does not make any representations or warranties of any kind concerning the appearance, performance or safety of any prize awarded.  Upon request, winner(s) must consent (and confirm such consent in writing) to the use of their name, voice, picture or other likeness without compensation for promotional purposes as determined by Sponsor except for residents in TN and where prohibited by law

7.         Taxes.  Any valuation of the prize(s) stated above is based on available information provided to the Sponsor, and the value of any prize awarded to a winner may be reported for tax purposes as required by law.  Each winner is solely responsible for reporting and paying any and all applicable federal, state and local taxes related to the prize(s) and paying any expenses associated with any prizes which are not specifically provided for in the official rules.    Any person winning over $600 in prizes from the Sponsor must provide the Sponsor with valid identification and a valid taxpayer identification number or social security number before any prize will be awarded; such winners will receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS for the retail value of the prize. 

8.           Conduct and Decisions.  By participating in the Promotion, participants agree to be bound by the decisions of Sponsor personnel.  Persons who violate any rule, gain unfair advantage in participating in the Promotion, or obtain winner status using fraudulent means will be disqualified.  Unsportsmanlike, disruptive, annoying, harassing or threatening behavior is prohibited.  The Sponsor will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Promotion and the Sponsor’s decisions concerning such disputes shall be final.  If the conduct or outcome of the Promotion is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of the Sponsor, the Sponsor reserves the right to terminate this Promotion, or make such other decisions regarding the outcome as the Sponsor deems appropriate.  All decisions will be made by the Sponsor and are final.  The Sponsor may waive any of these rules in its sole discretion.  ANY ATTEMPT BY A PARTICIPANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY CIRCUMVENT, DISRUPT OR DAMAGE ORDINARY AND NORMAL OPERATION OF THIS PROMOTION, TELEPHONE SYSTEMS OR WEBSITES, OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT PERMITTED BY LAW.

9.         Miscellaneous.  The Sponsor may substitute prizes, amend the rules or discontinue the Promotion at any time as announced on the Station(s).  The Sponsor disclaims any responsibility to notify participants of any aspect related to the conduct of the Promotion.  For a copy of the Official Rules visit the business office of the Station during normal business hours or mail a written request with a stamped, self-addressed return envelope to the Station address.  For a list of winners, mail a self-addressed stamped envelope to the Station address identifying the name of the particular contest that you would like to receive a winner’s list for.  All requests for winners lists must be mailed and postmarked within 5 business days after the contest has been concluded and received by the Station within one month after the contest has been concluded.

These are general contest rules, and rules for individual contests may vary.  Specific contests may have alternative rules and those rules will govern the contest.

10.         Compliance with Law.  The conduct of the Promotion is governed by the applicable laws of the United States of America, which take precedence over any rule to the contrary herein.  Station shall follow the applicable laws for conducting sweepstakes, including notice to the state attorney general or consumer affairs office, posting of a prize bond, furnishing lists of winners, running specific on-air disclaimers, providing specific written information about the Promotion, etc. as required by local and state law.
